Scope and Content

Parties: 1) Rt Hon George [Booth (1675-1758), 2nd] Earl of Warrington

2) Samuel Byrom late of Parr [pa. Prescot] co. Lancs esq

3) Isaac Greene of Prescot co. Lancs gent, and John Bent of Warrington co. Lancs gent

(1) grants to (2) an annuity for life of £100 out of the barony, manor and lordship of Warrington co. Lancs and the capital messuage called Bottoms Hall in Hattersley with appurtenances, payable twice-yearly at the Chester Exchequer.

Consideration: £1000.

For securing the above payments, (1) conveys by lease and release the barony, manor and lordship of Warrington and Bottoms Hall to (3) in trust to allow (1) to receive the rents and issues as long as the said annuity is paid, thereafter in trust to raise the annuity. (1) covenants to indemnify other parties from all taxes, leys etc.

Recitals: i) mortgage of Warrington by (1) to Hon Charles [Robartes, 2nd] Earl of Radnor and Hon George Booth for £5000, 25 March 1698; ii) demise for 100 years of Bottoms Hall by Henry [Booth (1651-94), 1st] Earl of Warrington, to George Booth of Chester esq and others upon trust for raising £10,000 portions (discharged), 24 September 1691 [EGR1/8/10/4]; iii) raising of further charge on above estate by (1) for portions for (1)'s brothers Langham and Henry Booth, 12 April 1698 [EGR1/8/11/5], who agree to postpone their annuities.

Endorsed on release: "Cancelled"; on both: note of enrolment on Close Rolls, 21 February 1711/2.
