CORRESPONDENCE: Re. an accident which occurred on 30 Jan. 1868 when a wagon loaded with straw overturned in Park Lane outside Mrs Yale's house and demolished the entrance gates, pillars, a portion of the iron fencing and destroyed some large shrubs. The accident was caused by a water spring having broken through the crown of the road because of the neglect of the surveyor. The owner of the wagon, Mr Harding, begain to repair the gates but then refused to continue claiming that he was not liable because the road was faulty. Mrs Yale consulted her lawyer and it was decided to take the case to court. However the County court lawyer refused the case because there was no evidence to prove that the wagon driver had overloaded the wagon or driven dangerously and by this time the offending section of the road had also been repaired. It appeared, therefore, that Mrs Yale had no remedy.
