Scope and Content

CJN has acquired most of the deeds for the Conwy site and read them through. He notes that the site was acquired in two parts, the part that the purification tanks are on being purchased from Conway Borough Council in 1920. As far as CJN can tell, there is no obligation on the owners of the site to provide and maintain a mussel purification unit; but it does include covenants specifying that no buildings other than those necessary for the purification of mussels under the Conway Mussel Fishery Order, 1912, are to be erected, as well as directing the size and type of buildings and imposing an obligation to plant trees. It appears from the 1912 Order that the Corporation is obliged to manage the mussel fishery and provide a purification unit. He is unclear about the significance of MAFF having assumed responsibility for the purification unit, and it may be that in doing so, they are now obliged to maintain it. Suggests that advice be sought from MAFF lawyers.
