1. George Gwynne Bird
2. Silvanus Padley
On 8 Aug 1845 2. advanced the sum of £800 to 1. upon an understanding in writing. 1. agreed to assign 2. policies of insurance on his life and to give any security which he might require. The sum of £500 plus interest was still owed to 2. by 1. from 1 Jun 1852
In Nov 1853 2. filed a bill in the High Court of Chancery against 1., as there had been no assignment of policy of insurance and no security had been given
To settle the matter, in Jun 1854 1. agreed that 2. should by or before 25 Mar 1854 be assigned the copyhold and leasehold premises and also the said policies on insurance and apply the clear monies arising from the sale of the premises towards payment of the mortgaged sum of £500 owed to Nathaniel Worsley (see LAC/10/3/3/6). The cleared monies from the sale of policies on insurance should go towards payment of the debt of £800. As 1. failed to perform the said agreement, 2. filed an amended bill of complaint against 1. for the purpose of enforcing his lieu upon the policies of insurance and copyhold and leasehold estates.
1. now agrees to surrender to the Lord of the Manor of Oystermouth the copyhold premises as surrendered by Catherine Tetherly in Sep 1845, and agrees to assigns leasehold premises as recited in lease of 17 May 1855
