Covenant, dated 19 Dec 1768; (i) Calvert Richard Jones of Swansea esq. and Elizabeth his wife, daughter and devisee of Lucy Allen of Holiwell (co. Herts) and (ii) William Hurst of Gabalfa esq., one of the executors and residuary legatees of Edward Hurst, deceased and Lucy his wife, being the other daughter of Lucy Allen; and Edward Hurst of Gabalfa, gent.: Recites: Thomas Herbert died 25 Feb 1739 intestate with estates in Glamorgan and Monmouth, leaving Roger Powell esq. (deceased) as heir ex parte paterna and Lucy Allen widow (deceased) as heir ex parte materna. Both claim the estate but Roger entered possession. Lucy filed in Chancery for recovery, died before proceeding with, her heirs are Elizabeth Jones and Lucy Hurst, her children. Recites conditions of her will: £5000 each on majority, remainder to John Phillips and Edward Hurst their heirs. If either die without issue then estate to go to Edward Hurst. Edward Hurst would have £4000 payable in £500 yearly instalments. However, if legacy to her daughters, Elizabeth and Lucy fell short of £1500 pa. then the difference to be taken from Edward Hurst's £4000. Hurst then revives the suit for Herbert's land since passed to PowellD/D CRJ 25
