Mortgage and assignment of mortgage by lease and release

Scope and Content

Lands as in YM/D/SN/156 (the close of 3 acres being now described as 3 acres 2 roods), and as acquired by William Kirby in YM/D/SN/158 and YMD/SN/160.
a. Lease.
John Sawyer the younger of East Haddlesey, gent., and William Kirby of Snaith, yeoman; Robert Wharrey of Cawood, gent.
For 1 year, at peppercorn rent.

b. Release.
John Sawyer the younger of East Haddlesey, gent.; William Kirby of Snaith, yeoman; Robert Wharrey of Cawood, gent.; William Vaux of Cawood, grocer.
Refers to mortgage, Sawyer's interest being now absolute, but Kirby having maintained the interest payments. Kirby needs a further advance of £100. He is to repay £210 (the interest being 5%) as follows: £5 on 6 January next, £205 on 6 July 1777.
Sawyer may take possession in case of default, after which Kirby is to assure his title at his own expense. Kirby may retain the use of the property until default is made in the payment of the interest. The interest is payable on 6 January and 6 July, or within 40 days, at 5%. If it is paid within time, the rate is to be reduced to 4½%.
Sawyer assigns the remainder of the term in the mortgage to Vaux, as trustee for Wharrey.
£100 from Wharrey to Kirby to Sawyer.
£100 from Wharrey to Kirby.
5s. from Vaux to Sawyer.
