Scope and Content

Recites John Cawthorn's release of his 10+ acres in Sutton Fen to Henry, Ambrose and William Goode in 1827 (Doc 1790). All the Goodes have now died, Ambrose being the last survivor. Of Ambrose's heirs, his son Ambrose Goode jnr is now also deceased, but Ambrose snr's will has been proved and his surviving heirs are Joseph Bridgewell Whiting of King's Lynn, surgeon, and John Cross Morphew of Terrington St Clement, Norfolk, clerk. The mortgage loan of #800 has yet to be repaid, although no interest is owing, and Goode's heirs have now called it in. Accordingly, Cawthorn has persuaded William Pleasance of Cambridge, tobacconist, to take over his debt and to lend him a further £50. Thus the 10+ acres of freehold adventure land in Sutton Fen now serve as security for a loan of £850 (plus 5% interest) from Pleasance to Cawthorn. Cawthorn undertakes to surrender conditionally copyhold property in Hive End and Horseload Fen, manor of Chatteris Nunns, as further assurance. Stated date of repayment is 12 Dec 1843. Cawthorn additionally undertakes to insure all buildings so mortgaged against fire in the sum of £200. Tripartite indenture, 3 pages, signed and sealed by Whiting, Morphew, Cawthorn and Pleasance, witnessed by J C Williams of King's Lynn, solicitor, Giles A Clark, his clerk, and [?J E or H] Marshall, receipts for both £800 and £50 on verso, signed by Whiting and Morphew, and Cawthorn respectively, and witnessed by the same parties, duty stamps. Endorsed as entered in the Bedford Level Company Register on 17 July 1843.
